Please read these Terms of Service (“Terms”) carefully before using Product Ad Kit (“the Service”, “we”, “us”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. What the Service Does

Product Ad Kit uses artificial intelligence to create product images and advertising materials, including ad angles, hooks, scripts, captions, visual directions, and image-generation prompts, from product information and images you provide. The Service can generate finished image files. Video-related output is currently limited to concepts, scripts, prompts, scene directions, and similar planning material; the Service does not currently generate finished video files.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

3. Free Preview

We offer a free preview that does not require an account. To keep the free tier available for everyone, free previews are subject to fair-use limits, including rate limiting per IP address and other automated abuse-prevention measures. We may adjust, restrict, or discontinue the free preview at any time. Attempting to circumvent rate limits or abuse-prevention measures is a violation of these Terms.

4. Purchases, Subscriptions, and Billing

Merchant of Record. All payments are processed by our payment partner, Creem (creem.io), acting as the Merchant of Record. This means Creem is the legal seller for your transaction, handles payment processing, applicable taxes (such as VAT or sales tax), and issues your invoice. We never see or store your card details.

One-time purchases. A one-time purchase grants access to the full ad kit generated for the specific product you submitted.

Subscriptions. Where a subscription plan is offered and its checkout is enabled, it bills on the terms shown at checkout. Available cancellation methods are shown with the applicable purchase or can be requested by contacting support@productadkit.app. Displaying a plan does not mean every checkout path or subscription feature is available in every environment.

Price changes. We may change subscription prices with reasonable advance notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.

5. Refund Policy

Because our product consists of digital content generated on demand and delivered immediately, the following refund policy applies:

• Technical failure: If you paid for a kit and the Service failed to generate or deliver it due to a technical error on our side, contact us within 14 days and we will regenerate it or issue a full refund.
• One-time purchases: Once a full kit has been successfully generated and delivered, the purchase is generally non-refundable. We review refund requests case by case — if something is genuinely wrong, email us and we will make it right.
• Subscriptions: You may cancel at any time to prevent future charges. Charges already incurred for a billing period in which the Service was used are non-refundable, except where required by law.

Nothing in this policy limits any rights you have under applicable consumer protection law. To request a refund, email support@productadkit.app with your order details.

6. Your Content and Our Output

Your input. You retain all rights to the product descriptions and other material you submit (“Input”). You grant us a limited license to process your Input solely to operate and provide the Service, including sending it to our AI infrastructure providers for generation.

Generated output. Subject to your compliance with these Terms and payment of applicable fees, we assign to you all right, title, and interest we may have in the generated ad kits (“Output”). You may use Output for any lawful purpose, including commercial advertising.

You are responsible for your Input. You represent that you have the rights to submit your Input and that it does not infringe any third party’s intellectual property or other rights.

7. AI Disclaimer

Output is generated by artificial intelligence and may contain inaccuracies, errors, visual defects, third-party material, or claims that are not true of your product. You are solely responsible for reviewing, editing, and verifying all Output before using it publicly, including ensuring that your advertising complies with applicable advertising laws, platform policies (such as TikTok’s ad policies), and truth-in-advertising requirements in your market. We do not guarantee that Output is accurate, suitable for commercial publication, free of third-party rights, or likely to improve performance or return on advertising spend. We also make no guarantee that Output will comply with any third-party platform’s rules.

8. Acceptable Use

You agree not to use the Service to:

• Generate advertising for illegal products or services, or content that is deceptive, defamatory, or infringes the rights of others;
• Generate advertising for products in prohibited or heavily regulated categories where you lack required authorization (e.g., weapons, illegal drugs, counterfeit goods);
• Submit Input containing another person’s personal data without authorization;
• Reverse engineer, scrape, or programmatically access the Service outside of intended use, or circumvent rate limits, abuse-prevention measures, or access controls;
• Resell or redistribute access to the Service itself.

We may suspend or terminate access for violations of this section.

9. Service Availability

We strive to keep the Service available but do not guarantee uninterrupted, error-free operation. The Service depends on third-party infrastructure (hosting, databases, AI model providers) that may experience outages. We may modify or discontinue features with or without notice.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your Input, your use of Output in advertising, or your violation of these Terms.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination (including Sections 6, 7, 10, 11, and 12) will survive.

14. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the latest version. Material changes will be communicated via the Service or by email where practical. Continued use after changes take effect constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of Singapore, without regard to its conflict-of-law rules. Any disputes shall be resolved in the courts of Singapore.
